I always advise my Sellers to disclose, disclose, and disclose! Utah law requires Sellers to disclose in writing any defects in the property known to the Seller that can materially affect the value of the property that cannot be discovered by a reasonable inspection by an ordinary Buyer. This includes knowledge of lead-based paint, mold, Radon gas, water rights, any long-term or short-term leases, existing property management agreements, and any restrictive covenants, rules and regulations affecting the property.
However, the Seller is not obligated to disclose that someone died in the house unless asked. Those who aren’t fans of the TV show Ghost Hunters may want to make sure to keep that question in their back pocket!
